Terms of Use

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and {{DEVELOPER_NAME}}, {{DEVELOPER_ADDRESS}} (“we”, “us”), regarding the Android application Linvy: Phone Cleaner (the “App”) and this website. By downloading, installing or using the App you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the App and uninstall it.

2. Who may use the App

The App is intended for adults. You must be at least 18 years old or the age of majority in your country, whichever is higher, and able to enter into a binding agreement. You must use the App only on a device that you own or are authorized to manage.

3. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Android devices that you own or control, for personal, non-commercial purposes, in accordance with these Terms and the Google Play Terms of Service.

You may not: copy, modify or create derivative works of the App; decompile, reverse engineer or disassemble it, except to the extent the law expressly permits this despite this restriction; remove proprietary notices; rent, sell, sublicense or redistribute the App; or bypass, block or interfere with its advertising, security or technical limitations.

4. What the App does — and does not do

The App helps you analyze and free up storage: it finds junk files (cache, thumbnails, temporary files, logs, installation files, empty folders), duplicate and similar photos, large files and rarely used apps; shows device status; explains which permissions other apps have; and can show reminders and a quick-tools panel.

• The App shows real data provided by Android. It does not promise that your device will become faster, that its battery will last longer, or that a specific amount of space will be freed. Results depend on your device, its Android version and the files on it.
• The App is not an antivirus or security product. The “App access” check only describes permissions; a permission does not mean that an app is harmful.
• Android limits what third-party apps can do (for example, they cannot clear other apps' cache directly). Where this applies, the App guides you through the system settings instead.
• Some features require permissions that you grant. Without them those features are unavailable.

5. Your files and deletion

You are solely responsible for choosing which files and apps to delete. Before cleaning, the App shows what it found and lets you review and untick items; photos and large files are deleted only after you confirm.

• Photos, videos and files removed from “Duplicates” and “Large files” go to the trash for 30 days by default and can be restored during that time. After 30 days, or if you choose “Delete immediately” or “Delete forever”, they are deleted permanently.
• Junk such as cache, thumbnails, temporary files, logs and installation files is removed immediately and cannot be restored by the App.
• Similarity of photos is estimated by an algorithm and can be wrong. Always look at the suggested selection before deleting.
• Keep a backup of important data. To the extent permitted by law, we are not responsible for the loss of files that you chose to delete, including by automatic cleaning that you turned on.

6. Notifications and background features

If you allow notifications, the App may show alerts about low storage, reminders and the results of features you turned on. The quick-tools panel, automatic cleaning (which removes only safe junk such as cache and temporary files) and the background check work only after you turn them on, and you can turn them off at any time in the App's settings. Android or your device manufacturer may restrict background work; we cannot guarantee that background features run at a particular time.

7. Ads and rewarded features

• The App is supported by advertising provided by third parties (see the Privacy Policy). We are not responsible for the content of ads or for products and websites of advertisers. Your dealings with advertisers are solely between you and them.
• Some features are unlocked for a limited time by watching an optional rewarded video, for example similar-photo search (1 hour, the first search is free), the background check (24 hours) or a trash action. If no video is available, the feature is opened anyway.
• Rewards have no monetary value, cannot be exchanged, transferred or refunded, and expire after the stated time. We may change which features are unlocked this way, for how long, and how often ads appear.
• You must not use automated means, emulator farms or other methods to generate artificial ad impressions or clicks.

8. Price and Google Play

The App is currently provided free of charge and does not offer in-app purchases or subscriptions. If paid features are introduced, their price and terms will be shown before purchase, and purchases will be processed by Google Play under its terms. The App is distributed through Google Play; Google is not a party to these Terms and is not responsible for the App.

9. Acceptable use

You agree not to use the App: in violation of any law; to access, delete or modify data on a device or account you are not authorized to manage; to interfere with or disrupt the App, its advertising or the services of our partners; or to attempt to gain unauthorized access to any system.

10. Intellectual property

The App, including its design, illustrations, text, code and the Linvy name and logo, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer any rights to you other than the license in section 3. The App includes open-source components distributed under their own licenses, which prevail for those components. If you send us feedback or suggestions, we may use them freely without obligation to you.

11. Third-party services

The App relies on third-party services such as Google Play services, Firebase, AppLovin, AppMetrica and Tenjin, and may open other apps or Android settings (for example, the system uninstall dialog or an app's info page). Their use is subject to their own terms and policies. We are not responsible for third-party services, and their availability may change.

12. Privacy

How we and our partners handle data is described in the Privacy Policy, which is part of these Terms. In short, photos, files and the list of your apps are analyzed only on your device.

13. Updates and availability

We may update the App, change, add or remove features, change settings remotely (for example, ad frequency or the duration of rewards), or stop providing the App, in whole or in part, at any time. Some updates may be required to keep using the App. We do not guarantee that the App will be available on every device or Android version, or that it will work without interruptions or errors.

14. Disclaimer

To the maximum extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App will meet your requirements, be error-free, or that defects will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties; in that case the exclusions above apply only to the extent permitted.

15. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, files, profits or goodwill, arising from or related to your use of or inability to use the App. Because the App is provided free of charge, our total liability for any claim relating to the App is limited to USD 50 (fifty U.S. dollars) or the minimum amount allowed by applicable law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct, and nothing affects your statutory rights as a consumer.

16. Termination

You can stop using the App at any time by uninstalling it. We may suspend or end your license if you materially breach these Terms. Sections that by their nature should survive termination (including 10, 14, 15 and 17) will survive.

17. Governing law and disputes

These Terms are governed by the laws of {{GOVERNING_LAW}}, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory provisions of the law of the country where you live, and you may bring a claim in the courts of that country. Before going to court, please contact us — most issues can be resolved quickly by e-mail.

18. Changes to these Terms

We may change these Terms. The new version will be published on this page with a new “Last updated” date; significant changes will also be announced in the App or its Google Play listing. If you continue to use the App after the changes take effect, you accept the updated Terms. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver.
